Ruling returns cases to lower courts for additional proceedings.
In a 5-4 decision rendered Thursday, the Supreme Court ruled that President Joe Biden could decide to end the “Remain in Mexico” immigration policy of the previous administration. The majority decided that ending the policy, which required asylum seekers coming from the southern border to reside in Mexico while awaiting immigration hearings, did not violate federal immigration law.
Chief Justice John Roberts authored the opinion, and the high court returned the cases to lower courts for additional proceedings. By ruling in favor of the administration, the court said it acted properly when it sought to end the policy, also known as the Migrant Protection Protocols, enacted in 2019.
In a dissent joined by Justices Neil Gorsuch, Clarence Thomas, and Amy Coney Barrett, Justice Samuel Alito stated that the administration has released “into this country untold numbers of aliens who are very likely to be removed if they show up for their removal hearings.”
“This practice violates the clear terms of the law, but the court looks the other way,” Justice Alito wrote.
